ONTARIO OMBUDSMAN'S OFFICE FAILS TO PROTECT CITIZENS FROM HPARB'S LACK OF PROCEDURAL FAIRNESS AND ADHERING TO THE PRINCIPALS OF NATURAL JUSTICE.

Mr Shanoff, (Toronto Sun Columnist) I don't know if you have done an article on the Ombudsman's Office, but you may wish to take this on as they are not questioning the contradictions. We already know the CPSO is corrupt and HPARB from your article where you stated "it looks like HPARB just threw up their hands and said we give up"

The Chief Coroner's Office, the College of Physicians and Surgeons of Ontario, the Health Professions Appeal and Review Board, the Death Investigative Oversight Council, the Liberal government and Ms Deb Matthews and Premier Wynne apparently agree that it is perfectly within the accepted Standard of Care to:
--have open abdominal surgery without the mandatory antibiotic prophylaxis

--having not had the above, accepted that there was no need for antibiotics when the abdominal incision was oozing purulent liquid and was so infected that all staples were removed

--when test results showed "many gram negative bacilli", still it was quite acceptable to provide no antibiotics

ONTARIO CITIZENS----
And the College/HPARB totally ignored Dr. Andrew McCallum's letter to the College when he was Eastern Ontario Coroner. In it he states that infection was a contributing factor in Terra's death.
One must also wonder how on earth the Chief Coroner's death investigation failed to note the lack of antibiotics plus other issues contained within the hospital records and yet I have numerous pieces of correspondence from both Dr. Lauwers and Dr. McCallum stating they saw no issues with respect to the Standard of Care???

No Accountability or Transparency in Ontario--Dr. Bert Lauwers/Dr. Andrew McCallum/Dr. Laz Klein--Part Eleven

 A PRIMER ON THE LAW OF DEFAMATION IN ONTARIO
"Defamation is comprised of two subcategories between libel (libel refers to written defamatory statements)and slander(broadcasting of spoken defamatory words)

Proving a Claim in Libel and/or Slander
"the statement must be false!"

Defences to Actions in Libel and Slander
TRUTH--
"The first defence is the defence of truth. The defence can be made that the statement was truthful and therefore there was nothing false about the statement, meaning therefore, that the statement was not defamatory."


FAIR COMMENT--

"The second defence to an allegation of libelous statement is that the statements made were made as a fair comment. The defence of fair comment would be considered by the Court in situations where, by looking at the statement made, the facts and the situation, a conclusion can be made that the statements made were in actuality a fair commentary on the situation at hand and that the comments were fair and were not malicious."

QUALIFIED PRIVILEGE--
"The defence of qualified privilege arises normally in situations where the individual publishing these statements will escape any liability if it can be proven that the public good could be furthered in open debate.

Dear Ms. Bates:
In response to your letter of August 28lh, I reviewed the notes which you had sent me on this case. The Issue of antibiotic administration at the Time of conversion to an open procedure is really not relevant to the outcome for this patient. Antibiotics administered preoperatively prior to laparoscopic or open colorectal surgery are used by most general and colorectal surgeons, as they have been shown to reduce the incidence of wound infection, but really have no bearing on the incidence of anastomotic leak. Prophylactic postoperative antibiotics are thought to be unnecessary by many people. They really have very little impact on wound infection. With respect to this young woman's problem, I don't think that failure to give any prophylactic postoperative antibiotics has had any impact on her outcome.
              
I remain convinced that this young woman actually

had a subclinlcal anastomotic leak accounting for

her diarrhea and feeling of something not being

right. In spite of this, her white blood count and clinical findings were apparently unremarkable. 

I am still concerned about the lack of accurate

description of the findings in her abdomen at

autopsy. If any of the reviewers wish to discuss this matter with me, I would be available to be contacted by email or telephone at your convenience.

Telephone conversation with Dr. Blacked Out
Further to a telephone message and email I left with Dr. Blacked Out office earlier today, Dr. Blacked Out ; called me at 4:45 pm today.
I asked Dr. Blacked Out he could clarify the recent addendum he had sent in to his original independent opinion.
Specifically, I indicated that the panel wished to know if it was considered the standard of practice to administer prophylactic antibiotics in connection with (a) laparoscopic procedures not involving the bowel; and (b) open bowel resections.
Dr. Blacked Out indicated that the standard would require

administration of prophylactic antibiotics in connection

with laparoscopic procedures if the bowel were involved; however, in this case, Dr. Klein believed he would be dealing with a cyst only, so the standard would not require administration of prophylactic antibiotics for the laparoscopic procedure.

AWK Note:--- But when he discovered the cyst could not be removed with the laparoscopic procedure, open abdominal surgery should not have gone ahead without the patient being properly prepared.  This was not an emergency surgery but day surgery!  And notice above how they are attempting to excuse Dr. Klein's negligence of not administering prophylactic antibiotics!!
Dr. Blacked Out indicated that the standard of practice for open bowel resections is to provide antibiotic prophylaxis. However, he further clarified that such administration would not reduce the risk of anastomotic leak.
                                                                                                                                                      

AWK Note:--- But this is not the issue, it is about pre operative and post operative neglect which is clearly indicated.  And notice above how they are attempting to excuse Dr. Klein negligence of not administering prophylactic antibiotics!!
 As well from the following:

Now the College is supposed to be able to investigate a complaint made by an Ontario Citizen, but it appears they don't really have the expertise, required.  So, why are they allowed to continue to self-regulate???   See below:

The Committee recently considered a surgical complaint, which had been returned to the Committee from the Health Professions Appeal and Review Board. (A young female patient had unfortunately died after discharge following a diagnostic laparoscopy, open right hemicolectomy and excision of a mesenteric cyst.)                                                                                                                                                     
Although we do have a number of surgeons who sit on the 

committee, none felt qualified to comment upon the care

provided in this particular case.  Instead, they directed us to

AWK Note:  So, how were those surgeons, who made their second decision, able to come up with the decision when “none felt qualified to comment upon the care provided in this particular case”?

Having said that, we do not consider this oversight to have contributed to the unfortunate outcome in this case.”

1.     Notice the College’s use of the word, “neglected”                                   

 2.  Notice the College’s use of the word “oversight”.  Does this mean  “OOOOPS” ?                                                                                                     

 3.   “The Committee would suggest that Dr. Klein consider the routine use of antibiotics in such circumstances.”     “Suggest”?????? As opposed to “MUST”

“The second question related to whether perioperative antibiotics should have been prescribed.  Dr. XXXX stated that he found no evidence in the record of any antibiotics had been prescribed perioperatively.  He stated that it is the standard of practice with bowel surgery to administer antibiotics, either orally or intravenously, approximately 2 hours prior to surgery so that the drugs are circulating before the incision is made.

----- Watered-down disciplinary measure by the College.

If one looks up this surgeon's record at the College, you will not find any mention of my complaint and the College's decision.  So, an unsuspecting prospective patient will go "under the knife" and not be aware of the questions he/she should be asking with respect to pre and post operative care!
